Educational Copying – the “Very Antithesis of Fair Dealing” or Within Copyright’s “Breathing Space”? Part 2: Judicial Opinions

This article is the second in a three-part series investigating whether and when educational institutions may make unlicensed uses of textual works for teaching and learning purposes in five common-law countries: Australia, Canada, New Zealand, the United Kingdom, and the United States. Part 2 focuses on case law—court and tribunal rulings—addressing the permissibility of unpaid uses of protected works in various circumstances, including copying or distributing copyrighted materials for use by multiple students as course materials (educational or classroom copying) and the applicability of statutory users’ rights (copyright exceptions and limitations) to such uses.
